Welcome to ToppaOnly. By accessing or using this website and placing an order, you agree to be bound by these Terms of Service. Please read them carefully before making a purchase.

This site is operated by EcommWiz, LLC DBA ToppaOnly, based in Jacksonville, Florida. Throughout these terms, "we," "us," and "our" refer to EcommWiz, LLC DBA ToppaOnly. "You" refers to the customer, visitor, or user of this site.

1. Acceptance of Terms

By visiting our site, creating an account, or completing a purchase, you confirm that you are at least 18 years of age (or 13 years of age with verifiable parental or guardian consent) and that you agree to these Terms of Service in full. If you do not agree, please do not use this site.

2. Products & Made-to-Order Policy

All ToppaOnly products are made to order and printed on demand specifically for you at the time of purchase. As a result:

Orders enter production immediately upon placement and cannot be cancelled or modified after checkout.
Please allow 7–10 business days for production before your order ships.
Shipping transit time is in addition to the production window.
Product images on the site are representative. Minor variations in color may occur due to differences in screen displays and print processes.

3. Pricing & Payment

All prices are listed in US dollars. We accept all payment methods available through Shop Pay, including major credit and debit cards, Shop Pay installments, and any other options presented at checkout. Payment is collected in full at the time your order is placed.

We reserve the right to update pricing at any time without prior notice. Price changes will not apply to orders already placed and confirmed.

4. Shipping & Delivery

We currently ship to addresses within the United States only. We do not ship to P.O. boxes, APO/FPO addresses, or US territories at this time.

Once your order ships, you will receive a tracking number via the email associated with your order. Estimated delivery dates are provided by the carrier and are not guaranteed. ToppaOnly is not responsible for carrier delays, lost packages, or delivery failures caused by an incorrect address provided at checkout.

If your package is lost or significantly delayed, please contact us at support@toppaonly.com and we will work with you to find a resolution.

5. Refunds & Exchanges

Because all products are made to order, we do not accept returns or offer refunds for change of mind, incorrect size selection, or any reason other than a fulfillment error on our part. Please refer to our Refund & Exchange Policy for full details on how we handle eligible claims.

6. Customer Accounts

You may create an account on our Shopify-powered store to manage your orders, save your address, and track purchases. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us immediately at support@toppaonly.com if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms of Service or that we determine, at our sole discretion, are being used fraudulently or abusively.

7. Intellectual Property

All ToppaOnly designs, graphics, logos, and branding are the original creative work of EcommWiz, LLC DBA ToppaOnly and are protected by applicable copyright and trademark laws.

ToppaOnly designs are original works inspired by anime culture. We are not affiliated with, endorsed by, sponsored by, or officially connected to any anime studio, publisher, licensor, or intellectual property holder. Any resemblance to existing characters or properties is coincidental and reflects the broader anime aesthetic that inspires our creative work.

You may not reproduce, distribute, modify, or commercially exploit any ToppaOnly designs, images, or branding without our express written permission.

8. User Conduct

When using this site or your account, you agree not to:

Use the site for any unlawful purpose or in violation of any applicable laws
Attempt to gain unauthorized access to any part of the site or its systems
Submit false, fraudulent, or misleading information in connection with an order or account
Engage in any conduct that could damage, disable, or impair the functionality of the site

9. Disclaimer of Warranties

This site and its contents are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the site will be uninterrupted, error-free, or free of viruses or other harmful components. To the fullest extent permitted by law, ToppaOnly disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

10. Limitation of Liability

To the maximum extent permitted by applicable law, EcommWiz, LLC DBA ToppaOnly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this site or your purchase of our products, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these Terms or your use of the site shall not exceed the amount you paid for the order giving rise to the claim.

11. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms of Service, your use of this site, or any purchase made through ToppaOnly shall be resolved exclusively through binding arbitration administered in Jacksonville, Florida, in accordance with the rules of the American Arbitration Association (AAA). Both parties waive the right to a jury trial and agree that disputes may not be brought as class actions.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought exclusively in the courts located in Duval County, Florida.

13. Changes to These Terms

We reserve the right to update or modify these Terms of Service at any time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the site after any changes constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
